1. Introduction
OSEL Devices ("OSEL", "we", "our", or "us") is committed to protecting the privacy of users of the OSEL Hearing mobile application ("App"). This Privacy Policy explains how we handle information when you use our App, which provides hearing aid control and on-device hearing test services.
This Privacy Policy is published in compliance with the Information Technology Act, 2000, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 ("SPDI Rules") of India, as applicable to our services.
By using the App, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with this Policy, please do not use the App.
2. Information We Collect and Store
OSEL Hearing does not collect, transmit, or store any personal data on our servers. All data generated or entered through the App is stored exclusively on your device. Specifically, the following data may be stored locally on your device:
a) Audiogram Data
- Hearing test results and audiogram readings that you manually enter or generate within the App.
- This data is stored only on your device for your personal reference and is never transmitted to our servers or any third party.
b) Device Settings
- Your hearing aid preferences, volume levels, and sound profiles configured through the App.
- These settings are stored locally on your device solely to enable continuity of your preferred configurations.
All data stored through the App remains exclusively on your device. OSEL has no access to this data and it is never uploaded to any server or shared with any third party.
3. Information We Do Not Collect
OSEL does not collect, process, or transmit any of the following:
- Personal identification information (such as name, email address, phone number, or postal address)
- Device identifiers, IMEI numbers, or advertising IDs
- Usage analytics, behavioural data, or interaction logs
- Crash logs or diagnostic information sent to our servers
- Payment or financial information
- Any health or biometric data beyond what is stored locally on your device
4. Sensitive Personal Data or Information (SPDI)
Under the SPDI Rules, audiogram data (hearing health information) may qualify as sensitive personal data. Since all such data is stored only on your device and is never accessed by or transmitted to OSEL, we do not process your SPDI. You retain full ownership and control over this data at all times.
5. Location Permission
The App requires access to your device’s location. On Android, the operating system mandates location permission to scan for and connect to nearby Bluetooth devices. This is a system-level technical requirement for Bluetooth functionality to operate.
- Location data is used only to enable Bluetooth device discovery as required by Android.
- Your precise or approximate location is never recorded, stored, or shared with any party.
- We do not use your location for advertising, analytics, profiling, or any purpose other than enabling Bluetooth scanning.
Location permission is required by Android for Bluetooth scanning. OSEL does not store, process, or share your location data for any purpose.
6. Bluetooth Permission
The App requests Bluetooth access solely to discover, connect to, and communicate with your OSEL hearing aid device. Bluetooth communication data is used only for real-time device control and is not stored, logged, or transmitted outside your device.
7. Data Security
Since all data generated through the App resides exclusively on your device, the security of that data is governed by the security features of your mobile device (such as device lock, encryption, and operating system protections). We strongly recommend keeping your device operating system and the App updated to benefit from the latest security improvements.
OSEL employs reasonable technical and organisational measures in the design of the App to ensure that no user data is inadvertently transmitted or exposed.
8. Data Retention and Deletion
OSEL Hearing does not create user accounts and does not collect, transmit, or store personal data on OSEL servers. Audiogram data, hearing aid settings, sound profiles, and related app data are stored locally on the user’s device only.
Because this data is stored only on the user’s device, OSEL does not have access to it and cannot delete it remotely. Users can delete their locally stored app data at any time by:
- deleting audiogram records or saved settings from within the App, where available;
- clearing the App’s storage/data from the Android device settings; or
- uninstalling the App from the device.
When the App is uninstalled or its local storage is cleared, the locally stored app data is deleted from that device, subject to the device operating system’s normal deletion and backup behaviour.
OSEL does not retain user personal data on its servers. If a user contacts OSEL by email or through our website for support, we may retain the communication and contact details only for as long as necessary to respond to the request, maintain business records, comply with legal obligations, resolve disputes, or enforce our rights. Users may request deletion of such support communications by contacting info@oseldevices.com.
9. Children’s Privacy
Our App does not knowingly collect personal information from children under the age of 13 years. Audiogram data entered in the App is stored only on the device and is not accessible to us.
We recommend that use of the App by children under the age of 18 be supervised by a parent or legal guardian. If you believe a child has used the App without appropriate supervision, please contact us at info@oseldevices.com.
10. Third-Party Services
The App does not integrate with third-party analytics services, advertising networks, or data brokers. No user data is shared with, sold to, or disclosed to any third party.

TERMS OF USE
1. Acceptance of Terms
By downloading, installing, accessing, or using the OSEL Hearing mobile application ("App"), you agree to be legally bound by these Terms of Use ("Terms"). These Terms constitute a legally binding agreement between you ("User") and OSEL Devices ("OSEL", "we", "our", "us").
If you do not agree to these Terms, please immediately uninstall and cease using the App. These Terms apply to all users of the App, including users accessing the App on behalf of a third party.
These Terms are governed by and construed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872, the Information Technology Act, 2000, and the Consumer Protection Act, 2019.
2. About the App
OSEL Hearing is a mobile application that enables users to:
- Control and configure OSEL hearing aid devices via Bluetooth connectivity
- Adjust volume, sound profiles, and device settings on compatible OSEL hearing aids
- Perform on-device hearing screening tests and view audiogram results
- Store and track audiogram data locally on the device for personal reference
Location permission is required by Android for Bluetooth device scanning. This does not affect App functionality in any other way.

IMPORTANT — PLEASE READ CAREFULLY:
The hearing screening tests provided within this App are intended for informational and personal screening purposes only. They do not constitute a medical diagnosis, clinical assessment, or substitute for professional audiological evaluation or medical advice.
OSEL Hearing is not a medical device approved by any regulatory authority for diagnostic purposes. The audiogram results generated by the App should not be used as the basis for any medical decision, including the purchase of hearing aids, without prior consultation with a licensed audiologist or qualified healthcare provider.
Do not rely solely on in-app hearing test results for any medical or clinical decision. Always consult a licensed audiologist or healthcare professional for a comprehensive hearing evaluation.
4. Eligibility
The App may be used by individuals of all ages. Use of the App by minors (persons under the age of 18) must be supervised by a parent or legal guardian, who shall be responsible for compliance with these Terms on behalf of the minor.
5. Licence to Use
Subject to your compliance with these Terms, OSEL grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on your personal mobile device solely for your personal, non-commercial use.
This licence does not include the right to:
- Sublicense, sell, resell, transfer, assign, or commercially exploit the App
- Modify, translate, adapt, or create derivative works based on the App
- Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
- Remove any proprietary notices, labels, or markings from the App
6. Acceptable Use
You agree to use the App only for its intended and lawful purposes. You agree not to:
- Use the App in any manner that violates applicable Indian law or any applicable foreign law
- Interfere with or disrupt the functionality of the App or connected hearing aid devices
- Use the App in a manner that could harm yourself, others, or your hearing device
- Attempt to gain unauthorised access to any system or network connected with the App
- Use the App for any fraudulent or deceptive purpose
7. Intellectual Property
All content, design, code, algorithms, user interface elements, and functionality within the OSEL Hearing App are the exclusive property of OSEL Devices and are protected by applicable intellectual property laws, including the Copyright Act, 1957 and the Trade Marks Act, 1999 of India.
You may not reproduce, distribute, publicly display, publicly perform, transmit, or create derivative works of any portion of the App without express prior written permission from OSEL.
8. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW.
OSEL does not warrant that:
- The App will be error-free, uninterrupted, or free of viruses or other harmful components
- The App will be compatible with all devices or operating system versions
- The audiogram or hearing screening results generated by the App will be accurate or clinically reliable
- The App will meet your specific requirements
9. Limitation of Liability
To the maximum extent permitted under applicable Indian law, OSEL shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of or in connection with your use of, or inability to use, the App, including:
- Loss of hearing device functionality resulting from App use outside recommended guidelines
- Inaccuracies in hearing screening test results
- Reliance on in-app audiogram data for medical decisions without professional consultation
- Any loss of data stored on your device
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be lawfully excluded or limited under Indian law.
10. Indemnification
You agree to indemnify, defend, and hold harmless OSEL, its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the App, your violation of these Terms, or your violation of any applicable law or the rights of any third party.
11. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall first be attempted to be resolved through mutual good-faith negotiation.
If unresolved within 30 days of written notice, disputes shall be subject to the exclusive jurisdiction of the competent courts located in [City, State], India.
12. Termination
OSEL reserves the right to suspend or terminate your access to the App at any time, with or without notice, if you breach these Terms or if we decide to discontinue the App or any part thereof. Upon termination, the licence granted to you under these Terms shall cease immediately.

We reserve the right to update these Terms at any time. Revised Terms will be posted within the App and/or on our website with a new "Last Updated" date. Your continued use of the App after such changes are posted constitutes your acceptance of the updated Terms.

14. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable under applicable law, that provision shall be deemed severable and shall not affect the validity or enforceability of the remaining provisions.
